What is the difference between Social Security Disability and SSI?
The Supplemental Security Income (SSI) program is a federal welfare program for the aged, the blind, and the disabled who have limited income and assets. The benefits are funded by general tax revenues. Unlike SSI, Social Security Disability functions like a private insurance plan. A claimant must have paid social security taxes recently enough and long enough in order to qualify for SSDI. The benefits are paid out of the Social Security trust fund.
I’ve been denied. What is the process now and what happens if I’m denied again?
Your case will be given a second look at the reconsideration phase if the initial application for Social Security Disability is denied. You may request for a hearing if you are denied a second time. This is where you will appear before an Administrative Law Judge (ALJ) who will look at your case to determine if you will be approved for disability. The ALJ is not bound by any prior determinations regarding your case. Your case could go before an Appeals Council if it is denied at the hearing phase.
What do I need to do to prepare for the hearing?
You will need to make sure that we have a list of any new and current medications as well as any new medical treatment regarding your disability. Our office will be able to answer any other questions that you may have.
Do I have to go to a hearing?
Not necessarily, it depends on the stage of your case. Your attorney will explain the process to you.
How long does it take to get a hearing?
Depending on the stage, your case will take up to 6 to 12 months to get to the hearing phase.
What should I wear and what should I bring to the hearing?
Bring your I.D. or driver’s license. Do not wear shorts or tank tops. If you are unsure about what to wear, then it is best to dress as if you are going to a job interview.
I have children. Should they attend my hearing?
Do not bring your children to your hearing unless someone can keep them in the waiting room. You will be in a hearing room with the judge so you will not be able to tend to your children while you’re away.
Why does Social Security Disability take so long?
