The Other Person Doesn't Have Insurance!


"What can I do if the person who caused the wreck does not have insurance or assets?"

If the person who caused the wreck you were involved in did not have enough insurance to cover your expenses, and does not have assets or simply did not have insurance to begin with, there are two options you might be able to follow. If the person did not have enough insurance, it's possible to file a claim under your underinsured motorist's policy if you have one. The underinsured motorist policy, is required by a number of states but not in Mississippi. This insurance generally covers medical costs up to the maximum liability amount that is carried by the driver, if the accident was caused by a motorist who was underinsured.

If the person did not have an insurance policy, or any assets then it is possible to file a claim under the uninsured motorist's policy on your insurance, or on anyone in your household's car insurance. Like underinsured motorists, uninsured motorists is not required by state law in Mississippi, but with 30% of drivers in the state driving without insurance it is a smart addition to make to your insurance policy. This policy will cover you almost like a liability claim will, and will cover your medical bills and wage loss, pain, suffering, disfigurement, emotional distress, and loss of future earning capacity up to the amount of your coverage.
