"If I am injured at work, why should I file a Worker's compensation claim?"
Mississippi law says if you have five or more employees you must have worker's comp insurance. When you get injured on work you are entitled to get worker's comp. Worker's compensation benefits include payments for lost wages, payment for medical services, payment for necessary rehabilitation services, and, unfortunately, in some cases, death benefits. So if you're injured on the job, there is no reason you should have to pay for your injuries out of pocket.
The most important thing to remember is that you've got to make a claim. Don't let the injury linger and then six months later make the claim, make the claim when the injury occurs. Then under worker's comp you're entitled to get your medical bills paid, gas mileage to and from the doctor, and if the doctor puts you off work for two or more weeks you're also entitled to get sixty-six and two thirds of your paycheck every two weeks. Once the doctor releases you, if you have a permanent impairment that can effect your wage earning capacity in the future, you're entitled to an additional settlement. These entitlements are things that should really be discussed with a professional lawyer.
Unfortunately, worker's compensation is a system whose rules vary state by state and whose outcomes are often unfair to sick and injured workers. The system is complicated, to win a workman's comp claim, a worker should consider getting a worker's compensation lawyer to help them handle a claim. At Richard Schwartz & Associates the lawyers understand the complexity of worker's compensation claims, and will do everything in their power to make sure you're fairly compensated after an accident on the job.
