I Was Bit By A Dog!


"I got bit by a dog, do I have a claim?"

If you happen to be bitten by a dog there are certain rules that apply as far as the owner's liability is concerned. In Mississippi we have something called the one bite rule. That means that you have to prove as the victim that the owner knew or should have known that this dog had the propensity to bite. When a dog previously has bitten someone, and the dog owner is aware of the same, the "one bite rule" makes him or her responsible for repeat bites by the same dog. In this state, legal liability for a dog bite also is based on a violation of a leash law, prohibition against dogs trespassing or running at large, or a similar animal control law, or the injury was caused intentionally by the person handling the dog. There are also certain breeds that have a greater propensity to bite and you need to be aware of that.

A dog bite victim who is injured in Mississippi must prove either that the dog owner was negligent. State law requires proof that the dog had the dangerous propensity to bite people, and that the dog owner knew it or should have known it before the accident. Negligence is the unreasonable failure to do something or not do something, which results in injury to a person. If you get bitten by a dog you might be able to make a recovery against the owner's homeowner's insurance. It all depends on if there is proper proof.
