Passengers in a car that were involved in a wreck can make a claim against the person who caused the accident just like you can under their liability coverage, or they can even file a law suit against the person who caused the accident. They are entitled to the same compensation as the driver of the car that was hit, except for damages to the automobile.

In the instance that the person who caused the accident doesn't have any assets or any insurance coverage then your passengers can make a claim under the uninsured motorists coverage of your vehicle. This means that they will be entitled to everything under that coverage for their injuries, lost wages, and other claims. In addition to that they would be entitled to medical payment under your med pay portion of your insurance policy if it existed.

In the unfortunate circumstance where you the driver are at fault for the car accident, your passengers will be able to make a liability claim under your insurance policy. If that did not provide them with the assistance they needed for their injuries, they could file a lawsuit against your for your assets. Their claims would be separate to the person who you actually hit and their passengers. This is why it is a good idea to have more then the state minimum for liability insurance if you can afford it.
